New Jersey water main job stalls after contractor's owner dies, and the town turns to the surety
Hopatcong, New Jersey, has postponed replacing an old water main under Bell Avenue because the owner of the company that won the contract died shortly before work was to begin. The borough is working with the firm's bonding company to get the job finished and has not set a new start date.
The owner died unexpectedly just before construction was scheduled to start, according to a borough public notice reported by WRNJ Radio on Oct. 31. The contract covers a water main that officials call aging and deteriorated. Bell Avenue will not be paved until the new main is in, so the fresh asphalt does not have to be cut open later. The report did not name the company or give the contract amount, and the borough said schedule details will come once completion arrangements are settled.
Going to the surety is the normal path when a bonded contractor cannot perform. A performance bond protects the project owner: after a default, the surety can lend the contractor money to finish, hire its own completion contractor, offer the owner a replacement firm to sign directly or pay the owner's completion bill, capped at the face value of the bond, according to a 2026 public works bonding guide from Buildermuse. Whatever the surety spends, it tries to recover from the contractor and everyone who signed the indemnity agreement, and owners of small firms, often with their spouses, commonly sign personally.
The borough has not said which option the surety will choose or whether the company can keep working without its owner. States set their own bond requirements for public work in statutes usually called Little Miller Acts, and the thresholds differ from state to state, Buildermuse notes.
Why it matters: On a public job, the performance bond is what keeps work moving when a small contractor loses its owner, and the surety then pursues the indemnitors. Owners of small firms should know who signed their indemnity agreement and who could run open jobs if they were gone.
